Participation in Beat the Clock LLC’s (“BTC”) Escape Room (the “Room”) and access to this website are governed by the below terms of service and should be read carefully by all visitors. If you do not agree to the terms of service, you cannot use this website or participate in the Room.
Intended Audience. You are prohibited from accessing this website if you are under eighteen (18) years of age.
No Online Reservations Made by Minors. If you are under eighteen (18) you may not use this website to make a reservation.
You agree to abide by the following Rules.
- Full refunds will be given to any cancellation within 48hours of your game booking for bookings purchased through our website. Cancellation notice of less than 48 hours will result in a rain-check for a future date. Bookings purchased through third party services or websites (such as Groupon or living social) will default to their cancellation and refund policies.
- The use of electronic devices, including but not limited to mobile phones, recording devices (visual and/or audio), tablets, and cameras is prohibited inside the Room.
- You understand that if you must leave the Room prior to finishing the experience you may be excluded from re-entering the room at the BTC’s or its employees’ discretion without refund.
- You agree to adopt proper standards of behavior and cooperate with the BTC’s employees at all times.
- If you are under the influence of alcohol or drugs you may be turned away without refund.
- You understand that participation will not require the destruction or misuse of objects in the Room and agree to be liable to BTC for all damages caused by your actions.
- Children ages 14 and under must be accompanied by an adult to participate. A parent or guardian signature is required for all participants under 18.
Participation Agreement. Room participants will be required to sign a Participation Agreement, Release and Indemnity (below) prior to participation.
Links to other websites. BTC may link to third party sites from time to time on this website. BTC does not have control over these sites. Therefore no representation is given as to the safety or content of such third party sites.
Limitation of Liability. BTC is not liable to you or third parties for the content of this site including the availability, accuracy, timeliness, or reliability of information and services presented by the site. BTC gives no warranty, implied or express, regarding the security of this site, including the possibility of unauthorized persons to intercept or access information you send through this website.
Intellectual Property. Copyright and other relevant intellectual property rights exists on all text relating to BTC’s services and the full content of this website. Beat the Clock Escape Room is a trademark and trade name of Beat the Clock LLC.
Use of Information. BTC will not sell your information transmitted through this service to any third party. Some third parties may access your information when using this site to facilitate reservations and payment.
Changes to Terms of Service. BTC reserves the right to change these Terms of Service from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms.
Jurisdiction. The Terms of Service are governed by Tennessee law.
By choosing to reserve an event on this website, in consideration of the services of BTC, operator of the Room, you also agree to the following Participation Agreement, Release and Indemnification (in addition to the Terms of Service above):
BTC IS NOT RESPONSIBLE FOR ANY INJURY (OR LOSS OF PROPERTY) TO ANY PERSON SUFFERED WHILE PARTICIPATING, OR ANY OTHER WAY INVOLVED IN BTC’S ACTIVITIES FOR ANY REASON WHATSOEVER, INCLUDING NEGLIGENCE ON THE PART OF BTC, ITS AGENTS, OR EMPLOYEES. PLEASE READ THIS AGREEMENT CAREFULLY AS IT RELATES TO YOUR LEGAL RIGHTS.
BTC conducts activities that involve participants escaping from a room using clues and solving puzzles (the “Activities”). Participant/Parent is aware (i) that the Activities may result in injury, or illness including, but not limited to bodily injury, disease, strains, fractures, or other ailments that could cause serious harm or disability; (ii) these risks and dangers may be caused by the negligence of the BTC, or its employees, officers or agents, the negligence of the Participants, the negligence of others, accidents, breeches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (iii) by Participant’s participation in these activities, Participant/Parent hereby assumes all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of BTC, its agents, officers, or employees or by any other person.
Participant/Parent is fully aware of these risks, and in consideration of Participant’s participation, Participant/Parent, on behalf of himself/herself, his/her heirs, assigns, executor, administrator and representatives, hereby releases and holds harmless BTC, its employees, officers or agents, from any and all liability, loss, damage, costs, claims and/or causes of action, including but not limited to all bodily injuries, death, and property damage arising out of or relating to Participant engaging in the Activities or any activities incidental thereto.
Participant/Parent understands that this Participation Agreement, Release and Indemnification is intended to be as broad and as inclusive as permitted by the laws of the State of Tennessee, and that if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full force and effect. Participant/Parent expressly waives the right to file a claim in any form, including but not limited to a lawsuit for damages, resulting from Participant’s participation. In the event that Participant/Parent files a lawsuit against BTC, Participant/Parent understands that, notwithstanding any claims of breach of this this Participation Agreement, Release and Indemnification that may be asserted by BTC, Participant/Parent agrees that (1) any and all disputes with BTC whether statutory, contractual or otherwise, including but not limited to personal injuries and/or illness shall be resolved by binding arbitration in accordance with rules of the American Arbitration Association (“AAA”). Except as may otherwise be provided in AAA’s Consumer Due Process Protocol that allows consumers to file certain claims in small claims court, you understand that by agreeing to this arbitration paragraph, you are giving up your right to a trial in court, either with or without a jury; (2) to file any claims solely in the state of Tennessee, and the substantive law of Tennessee shall apply in any such action without regard to the conflict of law rules.
Participant/Parent certifies that he/she has adequate insurance to cover any injury or damage Participant may cause or suffer while participating in the Activities, or else Participant/Parent agrees to bear the costs of such injury or damage. Participant/Parent further certifies that Participant has no medical or physical conditions that could interfere with his/her safety in the Activities or, alternatively, by signing this Participation Agreement, Release and Indemnification, Participant/Parent is willing to assume and bear the costs of all the risks that may be created, directly or indirectly, by any such condition.
Release for Use of Likeness
Participant/Parent hereby consents that BTC, or any person authorized by BTC, may photograph Participant and record his/her voice. Participant/Parent consents that BTC, or any person authorized by it, use the resulting photographs, slides, films, audiotapes, videotapes and negatives for any purpose, whatsoever, including (but not by way of limitation) the display, exhibition, publication and sale thereof in promotion, advertising and trade without any compensation or other consideration. Participant/Parent consents that the digital photographs, slides, films, audiotapes, videotapes and negatives be reproduced by any method and at any time, altered or unaltered.
Participant/Parent hereby releases BTC, any authorized person and all of their employees and representatives from any and all claims arising out of any publication, exhibition or the use of such digital photographs, slides, films, audiotapes, videotapes and negatives or arising out of any use of Participant’s likeness, voice or personality. Participant/Parent understands that such photographs, slides, films, audiotapes, videotapes and negatives shall remain the sole property of BTC.
